Terms and Conditions (T&C) of PromptingBirds GmbH i.G.
§1 Scope
1. The following General Terms and Conditions (hereinafter referred to as “T&C”) apply to all contracts concluded between PromptingBirds GmbH i.G., Werinherstr. 3, 81541 Munich, Commercial Register Number: (i.G.), Tax Number: (i.G.), and its customers via the website or other communication channels.
2. Deviating conditions of the customer are not recognized unless PromptingBirds GmbH i.G. expressly agrees to their validity in writing.
§2 Services
1. PromptingBirds GmbH i.G. offers offsite seminars, online seminars, consultations, and individual training concepts with in-house training.
2. The exact description of the respective service results from the product or service description on the website or from the individually concluded contract.
§3 Conclusion of Contract
1. The presentation of services on the website does not constitute a binding offer but an invitation to order. Contracts are concluded by a written confirmation from PromptingBirds GmbH i.G.
2. When booking via the website, the contract is concluded by clicking the “Buy Now” button or a comparable button.
§4 Prices and Payment
1. All prices are stated in Euros and are exclusive of statutory value-added tax.
2. Payment is made at the customer’s choice by invoice, credit card, or other payment methods offered on the website.
3. Invoices are to be paid within 14 days of receipt without deduction.
§5 Cancellation of Seminars
1. Cancellations by the customer must be in writing. For cancellations up to 14 days before the start of the seminar, a processing fee of 10% of the seminar price will be charged. Thereafter, or if the participant does not show up, the entire seminar price is due.
2. PromptingBirds GmbH i.G. reserves the right to cancel seminars due to insufficient participants or for other important reasons. In this case, the already paid participation fee will be refunded.
§6 Liability
1. PromptingBirds GmbH i.G. is fully liable for damages caused by intent or gross negligence. For slight negligence, PromptingBirds GmbH is only liable in case of a breach of a fundamental contractual obligation and limited to the foreseeable damage.
2. The aforementioned liability restrictions do not apply in the event of injury to life, body, or health.
§7 Final Provisions
1. Contracts between PromptingBirds GmbH and the customers are governed by the law of the Federal Republic of Germany, excluding the UN Sales Law.
2. If individual provisions of the contract with the customer, including these T&C, are or become wholly or partially invalid, this does not affect the validity of the remaining provisions.
